Festivus came early this year when a Florida man decided to use the 911 system as a means to air his grievances about the dinner he ordered at a seafood restaurant.

Stuart Police say that 51-year-old Nelson Agosto was warned about the size of the clams offered by Crabby’s Seafood Shack, but insisted on ordering them anyway. When his dish arrived, Agosto proceeded to get crabby with the server and staff agreed to give the gentleman a second plate on the house.

While the restaurant did everything within their power to please the man, Agosto was still not satisfied with his meal and decided to call 911 in order to complain about his dinner. Agosto was informed that his complaint was a misuse of the service and was told to instead contact police through their non-emergency line, according to a recording posted by CBS 12. Agosto refused and called back a second time, stating that he did not want to pay for his meal.

Agosto was arrested through a summons for the misdemeanor charge of misuse of 911. While police say he was technically arrested, he was not taken to jail. He is expected to appear before a judge on January 11, 2018.
